E-Verify uses Form I-9 data to verify the employment eligibility of the newly hired employees. If the Legal Entity (Company/Business Unit) responsible for employee hiring is not enrolled in the E-Verify, the requirements to complete Form I-9 is different. 

How are non E-Verify Legal Entities identified?

Since non E-Verify Legal Entities have no necessity for E-Verify processing, the DHS Client Setup is not required for them. The step to create DHS Client user ID and password to communicate with the USCIS E-Verify System is not needed.

How to complete Section 2/Supplement B when the Legal Entity responsible for employee's hiring is not registered for E-Verify?

When the legal entity responsible for employee's hiring is not registered for E-Verify,

1. the alternative procedure for remote verification of documents in Section 2/Supplement B is not supported. In this case, the checkbox indicating "Check here if you used an alternative procedure authorized by DHS to examine documents" in Section 2/Supplement B will be disabled.
