This is the last section of Form I-9 and is to be filled by the employer when the New Hire is a rehire within 3 years of the original date of hire (max) or the New Hire is a current employee whose document information must be reverified. Employers may also choose to update section 3 if the employee's name has been changed and is different from the name that was previously provided on Form I-9.

Who can access Section 3 activity?

Any user with I-9 Specialist role can access Section 3 activity. Typically this role is assigned to the users that verify the documents that the New Hire presents. 

How do you complete Section 3?

You can use Form I-9 Section 3 in the following scenarios:

  • Rehires
  • Reverificarion
  • Employee Name change


Note that the process navigates to above scenarios only if the onboarding invitation is in process completed status. 

Rehires

For information on how a candidate's transaction is determined as a rehire and completing Form I-9 Section 3, please check the Rehire page. 

Reverification

If the employee's current work authorization or work authorization document (whichever is sooner) is expiring, reverification is necessary to show the continued employment. This should be done before document expires, usually within 90 days. Reverification is not required for "US Citizen" or "Non Citizen of United States" or Legal Permanent Resident with I-551, Permanent Resident or Alien Registration Receipt Card and LIst B documents.

Employment authorization reverfication is necessary when the employee's employment authorization document (EAD) or receipt is expiring. For example: if the employee presents foreign passport with temporary I-551 stamp or MRIV notation, reverification must be done before the document expires or within one year from the date of issuance of I-94 if there is no expiration date. When the employee receives Permanent Resident Card (green card) and presents the document for reverfication, use form I-9 Section 3 on the current version of Form I-9 for recording the details. Enter the document information in the spaces specified in Section 3 and attest the form. Once the reverifcation is done using "Permanent Resident Card" the transaction is not eligible for further reverifications. Since green card indicate permanent residency in the United States, they should not be reverified.

The process of Reverification can be initiated in two different ways:

  • Employee Initiated I-9 Reverification
  • HR initiated I-9 Reverify via I-9 Console 'Info and Actions'

In both the scenarios, I-9 Reverification is launched as an additional invitation process that has the I-9 Specialist facing the Section 3 activity. 

Employee Initiated I-9 Reverification

Below are the steps involved in this process:

  • Initiated by the New Hire through Self Service actions.
  • New Hire provides correct document details to HR.
  • Appears as pending activity under My Tasks for the I-9 Specialist.
  • I-9 Specialist records new document details in Section 3 and attests.

HR initiated I-9 Reverify

Below are the steps involved in this process:

  • Initiated by the I-9 Specialist via I-9 Console "Info and Actions", Actions tab.

  • I-9 Specialist records new document details in Section 3 and attests.

Employee Name Change

Name correction is similar where candidates provide new name that they have obtained by initiating self service name correction lite weight additional invitation process. When completing Section 3 for rehre/reverification, the employer can also update the employee name details if there are any changes.

There are two ways to update the employee name.

  • Employee initiated I-9 legal name change
  • HR admin initiated name correction via I-9 Console 'Info and Actions'

Below are the steps involved in this process:

  • Initiated by the New Hire through Self Service actions.
  • New Hire provides correct name to HR.
  • Appears as pending activity under My Tasks for the I-9 Specialist.
  • I-9 Specialist records new name in Section 3 and attests.
